TERMS AND CONDITIONS

Welcome to Wakali Safaris. These Terms and Conditions outline the rules and regulations for booking and participating in our safari tours and related travel experiences. By confirming a booking with Wakali Safaris, you acknowledge that you have read, understood, and agreed to these terms and conditions.

1. Definitions

  • "Company" refers to Wakali Safaris.

  • "Client/You" refers to the individual or group making the booking.

  • "Services" refer to the tours, safaris, and travel-related experiences offered by Wakali Safaris.

2. Booking Process

  • Bookings are confirmed upon receipt of a deposit as outlined in Section 3.

  • All bookings are subject to availability.

  • Special requests (dietary, medical, accommodations, etc.) should be communicated at the time of booking. While we will endeavor to accommodate such requests, they are not guaranteed.

3. Payment Terms

  • A deposit of 30% of the total tour cost is required to secure your booking.

  • The remaining balance is due no later than 30 days before the tour's start date.

  • Payments can be made via bank transfer, credit card, or other methods as agreed upon with the Company.

  • Late payments may result in the cancellation of your booking without refund.

4. Cancellation Policy

By the Client:

  • Cancellations must be made in writing and are effective on the date received by Wakali Safaris.

  • More than 60 days before the start date: Full refund minus a $200 administrative fee.

  • 30-60 days before the start date: 50% of the total cost is refunded.

  • Less than 30 days before the start date: No refund.

  • Travel insurance covering cancellations is strongly recommended.

By the Company:

  • Wakali Safaris reserves the right to cancel a tour due to unforeseen circumstances, including but not limited to force majeure events (natural disasters, political instability, etc.).

  • In such cases, clients will be offered a full refund or an alternative tour of equal value.

5. Amendments and Changes

  • Any amendments to the itinerary requested by the Client may incur additional charges.

  • Wakali Safaris reserves the right to make changes to the itinerary or accommodations in the event of unforeseen circumstances. Any changes will be communicated promptly.

6. Pricing

  • All prices published on the Wakali Safaris website are quoted in USD and are per person, based on two persons, unless otherwise stated. Prices are provided as guidelines and are subject to change.

  • The following are excluded from the prices unless explicitly mentioned in the itinerary:

    • Costs of obtaining passports or visas.

    • Border taxes, if applicable.

    • International flights

    • Gratuities for guides, drivers, and hotel staff.

    • Travel and personal insurance.

    • Additional excursions or activities not included in the itinerary.

    • Personal expenses (e.g., beverages, souvenirs, laundry services).

  • Discount rates for children and peak-season supplements during high or festive seasons are not included in the listed prices and will be calculated separately.

  • While Wakali Safaris strives for accuracy, all prices published are guidelines only and subject to change. Wakali Safaris is not liable for pricing errors or adjustments made after publication.

  • The actual tour cost, including any variations, will be detailed in the invoice provided by Wakali Safaris. Quotations are valid for 14 days from the date issued, after which they are subject to review and possible adjustment.

7. Travel Insurance

  • It is mandatory for all clients to have comprehensive travel insurance covering:

    • Medical expenses, including emergency evacuation.

    • Trip cancellations or interruptions.

    • Loss of personal belongings.

  • Wakali Safaris is not liable for any loss, damage, or expense arising from the Client’s failure to obtain adequate insurance.

8. Health and Safety

  • Clients must ensure they are medically fit to participate in their chosen itinerary. Certain activities, such as climbing Kilimanjaro, require a higher level of fitness.

  • Clients must inform Wakali Safaris of any pre-existing medical conditions or dietary requirements.

  • Wakali Safaris reserves the right to refuse participation to anyone deemed unfit for the tour.

9. Liability

  • Wakali Safaris will take all reasonable precautions to ensure the safety and satisfaction of its clients.

  • However, Wakali Safaris is not liable for:

    • Injuries, illnesses, or accidents during the tour.

    • Loss or damage to personal property.

    • Delays, cancellations, or alterations caused by third parties (airlines, hotels, etc.).

  • The Client agrees to indemnify Wakali Safaris against any claims arising from their own negligence or actions during the tour.

10. Code of Conduct

  • Clients are expected to respect local customs, wildlife, and fellow travelers.

  • Any behavior deemed inappropriate or unsafe may result in the termination of your tour without refund.

11. Intellectual Property

  • All content on Wakali Safaris' website, including text, images, and branding, is the intellectual property of Wakali Safaris.

  • Clients may not use, reproduce, or distribute this content without prior written consent.

12. Complaints

  • Any complaints must be raised promptly during the tour so they can be addressed.

  • If the issue cannot be resolved on-site, a formal complaint must be submitted in writing within 14 days of the tour's conclusion.
